Terms of Service

Please read these terms carefully before using our website and services. By accessing our services, you agree to be bound by these terms.

Welcome to Tsunga Bamu Law International. These Terms of Service (“Terms”) govern your access to and use of our website, legal services, and any related platforms or communication channels. By using our website or engaging our services, you agree to these Terms. If you do not agree, please discontinue use immediately.

1. Scope of Services

We provide legal advice, representation, consultation, and related professional services within the areas of law we are licensed to practice. The specific services provided to you will be defined in a separate written engagement letter or agreement, which forms part of these Terms.

2. No Attorney-Client Relationship Without a Signed Agreement

Visiting our website, sending us an inquiry, or communicating with us does not create an attorney-client relationship. A formal relationship only begins after:

  1. We assess potential conflicts of interest, and
  2. Both parties sign an engagement agreement.

3. Client Responsibilities

Clients agree to:

  • Provide accurate, complete, and timely information
  • Cooperate in their legal matter
  • Respond to communication when needed
  • Pay all fees and disbursements as agreed
  • Not use our services for unlawful purposes

Failure to cooperate may lead to suspension or termination of services.

4. Fees and Billing

Our fees are charged in accordance with the applicable Law Society of Zimbabwe General Tariff, which is the standard applicable to all lawyers practising in Zimbabwe. The Law Society General Tariff permits us to charge:

  • Hourly
  • At a fixed rate
  • As a contingency (where permitted)
  • Or under hybrid arrangements

The fee structure will appear in your engagement agreement.

4.1 Payment Terms

Invoices are due upon receipt unless otherwise stated. Late, unpaid, or dishonoured payments may result in:

  • Interest charges
  • Pausing of legal work
  • Withdrawal from acting as your legal representative

5. Confidentiality

We maintain strict confidentiality in accordance with legal and professional obligations.

However, we may disclose information:

  • Where required by law or court order
  • To prevent imminent harm
  • To comply with ethical obligations
  • To service providers bound by confidentiality

5.1

We shall keep your affairs and the information we receive from you confidential and will not disclose it to third parties without your permission.

5.2 Money Laundering

We strictly comply with legal requirements and professional standards, as well as money laundering laws and practices.

In certain circumstances, we may have an obligation to disclose information to the relevant authorities regarding any suspicion of money laundering. Where we are asked to do so, we will notify you of the request or the sharing of information.

6. Use of Our Website

You agree not to:

  • Use the website for unlawful purposes
  • Upload malicious code, viruses, or harmful files
  • Attempt to gain unauthorised access to our systems
  • Copy or distribute website content without permission

9. Third-Party Services

We may use third-party service providers (e.g., IT, cloud storage, payment processors). These providers are required to follow confidentiality and data protection standards, but we are not responsible for issues arising from their systems beyond our control.

10. Termination of Services

We may terminate representation if:

  • You fail to pay fees
  • You act unlawfully or unethically
  • You withhold information or provide false information
  • Request us to act in a manner that is contrary to our ethical and professional duties as lawyers
  • Professional rules or conflicts require withdrawal

You may also terminate our services at any time by written notice, subject to paying all outstanding fees.

11. Governing Law

These Terms are governed by the laws of Zimbabwe. Any disputes shall be resolved exclusively in the courts of that jurisdiction.

12. Amendments to Terms

We may update these Terms from time to time. Changes will be posted on our website with a revised “Last Updated” date. Continued use of the website or services signifies acceptance of the updated Terms.
